New York Medical Negligence & Medical Malpractice Lawyers

Medical mistakes kill and injure thousands of people a year. Ellis Law (with our co-counsel) represents persons who suffer serious permanent injuries as a result of the carelessness or negligence of doctors, dentists or other medical care providers. No matter how careless a medical provider has been, under the law, the value of the case is solely dependent upon the injuries suffered because of that carelessness. Some common types of medical malpractice claims include a doctor whose carelessness causes an injury, a doctor who makes an existing injury worse, or a doctor who fails to diagnose an illness, or fails to diagnose it quickly enough. Other examples include:

  • Anesthesia errors
  • Birth defects or cerebral palsy
  • Brain injuries or Brain damage
  • Spinal cord injuries, paraplegia and quadriplegia
  • Emergency room delays and negligent treatment
  • Failure to diagnose or delay in diagnosing cancer, breast cancer, heart attack, meningitis, stroke or other serious medical condition
  • Medication and prescription mistakes
  • Misdiagnosis or late diagnosis
  • Obstetrical and gynecological malpractice
  • Surgical errors, negligence and failure to adequately monitor care after surgery
  • Infection and sepsis caused by negligence
  • X-ray misdiagnosis

Doctors, nurses, chiropractors, dentists, podiatrists and hospital staff may all be involved in cases of medical malpractice!

In order to prove medical malpractice, the injured person must present testimony at trial from medical experts to show that the defendant acted negligently. The court costs, stenographer's fees, etc. and the unbelievably high costs of these expert witnesses make medical malpractice cases extremely expensive. We know of several doctors who charge $5,500 a day or any part of a day to testify! Because of these high costs, many times it is difficult to recover enough money to cover the expenses of the case and the legal fees, unless a serious permanent injury is involved. We do not feel it is fair to our clients to take a case that could result in only enough money to pay the case expenses and give us a legal fee, and leave little or nothing for them. Thus, in fairness to you, we will only be able to represent you for a medical malpractice claim if you have suffered a severe, permanent injury.
